    Pirate Bay Founders Jailed for 1 Year

    Anyone else see this?  Is a year in jail really the right response?  Isn't it a bit like jailing Toyota if some old lady knocks down somebody in one of their cars?

    I don't agree with illegal downloading myself, did it once but the quality of most of the stuff was so awful I swore I wouldn't do it again, but even to me this seems a bit of an over-reaction.

    Surprisingly the site is still up, or at least was last time I checked. The founders are appealing the decision, but the ruling has no real legal implication outside Sweden, so there's nothing to stop similar operations such as Mininova carrying on for now.

    Am open to correction but weren't they found guilty of sharing specific files rather than for running a torrent tracker to facilitate the sharing of those files?

    No, they were found guilty of being "accessories to copyright infringment" (i.e. the service helped people infringe copyright), but the trial revolved around 30 copyrighted works.

    Looks like they have strong basis to appeal this, the judge did not reveal conflict of interest. What a farce.
